A resolution has been unanimously passed by the Milpitas City Council declaring San Jose's Newby Island Landfill a public nuisance.
Milpitas city officials say many people living in the city are concerned about the odors from the landfill and have voiced their opposition to the proposed expansion.
Landfill operator Republic Services of Santa Clara County says the stink has stopped and the area has made significant improvement with odor issues.
