Air Force, Solid Waste Authority To Intervene with Transfer Station

Dover, Del. -- A state appeals board has ruled that the U.S. Air Force and the Delaware Solid Waste Authority (DSWA) may intervene in an environmental appeal against the use of a transfer station located approximately 1,500 feet from the Air Force Base's main runway. Air Force officials have argued the transfer station may attract birds that could collide with aircraft.

A permit was issued last year to Eastern Shore Environmental (ESE) by the state Department of Natural Resources and Environmental Control (DNREC) to build the transfer station, after which the permit was appealed.

After six hours of arguments from attorneys for the DNREC, DSWA, ESE and the Air Force, an appeals board granted motions to intervene and denied ESE's motion to dismiss the appeal.
