E.L. Harvey & Sons Sues Town of Natick, Mass.

E.L. Harvey & Sons has filed a lawsuit against the town of Natick, Mass., alleging the town owes the waste management company nearly $200,000.

The legal dispute between the town and E.L. Harvey & Sons centers on fees the company was to pay the town for single stream recycling services and whether the town exceeded the contractual limit on the tonnage of recyclables E.L. Harvey agreed to receive, MetroWest Daily News reports.

The town, however, argues that E.L. Harvey has attempted since February 2018 to change and rescind terms of its 2013 contract. The town accuses the company of “unlawfully withholding services to gain additional concessions from Natick and of failing to fulfill contract obligations.”

Waste-management company E.L. Harvey & Sons Inc. has filed a lawsuit against the town of Natick, claiming the town owes it nearly $200,000.

The Westborough-based company claims in a civil complaint filed last November in Middlesex Superior Court that Natick owes the company $197,337.63. The figure represents the cost of single-stream recycling the company received and processed above the maximum amount stipulated in a 2013 contract between the company and the town, according to the suit.

A counterclaim filed by the town in December, also in Middlesex Superior Court, argues that E.L. Harvey has attempted since Feb. 1, 2018, to change and rescind terms of the 2013 contract. It accuses the firm of unlawfully withholding services to gain additional concessions from Natick and of failing to fulfill contract obligations.
