Some Boyd County residents opposed to the Big Run Landfill filed suit in Boyd County Circuit Court seeking that the courts, rather than regulatory agencies, decide whether to close the landfill.
Citizens of Boyd County Environmental Coalition filed suit Friday against the Boyd County Fiscal Court, River Cities Disposal (the landfill) and the Kentucky Energy and Environmental Cabinet.
The suit claims the fiscal court 10 years ago acted arbitrarily and unconstitutionally in approving a solid waste management plan providing 42.9 million tons of capacity for the landfill for a period of 30 years.
