NSWMA Sues County over Ordinance

Detroit -- The National Solid Wastes Management Association (NSWMA) and Republic Services, Fort Lauderdale, Fla., have sued Wayne County Michigan and County Executive Robert Ficano over a county ordinance prohibiting Michigan landfills from accepting soft drink bottles and cans from jurisdictions that do not have a beverage container deposit law like Michigan does. The lawsuit’s primary charge is that the ordinance is a violation of the Commerce Clause in the U.S. Constitution that says only Congress may regulate commerce with foreign nations and among the states.
