Progressive Development, L.L.C. owns approximately 12.416 acres of land and a 11,480 square foot, three bay solid waste transfer station and recyclable material collection point located within the City limits of Edmond, Oklahoma. The facility, which is located at Interstate 35 and Covell Road, operates under a solid waste permit issued by the Oklahoma Department of Environmental Quality (27a Okla. State Supp. 2000, §2-10-101 et seq) which allows it to accept residential and commercial non-hazardous waste, including construction/demolition waste. The company has a long term contract with the Edmond Public Works Authority (“EPWA”) to transfer all waste collected by EPWA within the corporate limits of the City at the firm fee of $24.50 per ton and commercial roll-off waste of $5.00 per cubic yard (but not less than $24.50 per ton). EPWA sanitation vehicles are granted a priority over other users of the facility and are required to provide to the City a maximum of 12-minute turnaround. The facility is also permitted to receive and transfer residential and commercial non-hazardous waste from any other outside source as long as they charge an amount equal to the fee charged to EPWA. The company also has entered into an operating and disposal agreement with a third party contractor to dispose of waste to any permitted landfill within Oklahoma. The company commenced operation on November 11, 2002.
The company is seeking to sell a 100% controlling interest in the business, either by sale of stock or assets for $6,500,000. Funds will assist the company in repaying outstanding debt and creating liquidity for its owners to pursue other real property development projects.
